- Option C: The parts warranty is transferable, but the labor warranty remains tied to the original purchaser.
9.Statutory warranty and coexistence
This conventional warranty is in addition to the statutory warranties provided by Quebec's Consumer Protection Act and the Civil Code of Quebec, notably:
- The warranty of quality (Consumer Protection Act, s. 37): the good must be fit for its intended use for a reasonable period of time, considering its price, the conditions of use, and the nature of the product
- The warranty against latent defects (Civil Code of Quebec, art. 1726)
- The warranty of conformity (Consumer Protection Act, s. 37)
These statutory warranties apply independently of this conventional warranty and cannot be waived. In case of conflict, the provision most favorable to the consumer prevails.
10.Limitations of liability
Subject to the mandatory provisions of Quebec's Consumer Protection Act and any other applicable law:
- Vinotech's liability is limited to repair or replacement of defective parts
- Vinotech is not liable for indirect, consequential damages or economic losses (loss of profits, loss of use, damage to other property, temporary lodging costs, etc.)
- Vinotech's total liability cannot exceed the original purchase price of the product
Some jurisdictions do not allow the exclusion or limitation of consequential damages. These limitations may therefore not apply fully to your situation.
